A woman from Villa Urquiza wanted to request a cohabitation certificate for a loan and ended up in a civil union.
Néstor Parisi, a lawyer with more than 25 years of experience, often shares curious cases of his clients on his social media. However, nothing prepared him for the unusual message he received from a client.
"Hey, I think I got married without realizing it", wrote the woman, who lives in Villa Urquiza. She was looking to obtain a cohabitation certificate to access a loan, but when selecting the procedure on the website, she ended up requesting a civil union without noticing the difference.
How did she realize the mistake?
The civil union hearing was held via Zoom, which made it easier for it to proceed without noticing the confusion. She only needed two witnesses, but she had only one, so she improvised and asked for help from the person closest to her: the painter who was working in her house.
The doubt arose when, during the hearing, they read her the rights and obligations that a civil union entails. "That's when it started to bother her, but she thought it was something normal for living with her partner," Parisi explained.
Days later, she received the official document at her home, and her surprise was total: the header said "Marriage". Desperate, she wrote to her lawyer to confirm if she had really gotten married.
Her partner's anger and the unexpected reaction
The mistake not only surprised her but also her partner. "The man got really upset and said: 'Look at the mess you got me into'. But then he ended up laughing and they accepted it," Parisi recounted.
Although the confusion was significant, the couple decided not to annul the civil union for the time being. "Either of them can request the termination at the Civil Registry without the need for the other, but for now, they preferred to leave it as it is," the lawyer explained.
What is the difference between a civil union and marriage?
In legal terms, a civil union is a middle ground between living together without papers and getting married. Although it doesn't grant inheritance rights, it allows for claiming economic compensation in case of separation if one of the partners is left at a financial disadvantage.
According to Parisi, this procedure is uncommon and is usually used to access health insurance or pension benefits. "The good thing is that once it's done, it's already registered, and there's no need to prove anything else in the future," he explained.
