The magistrate ordered an embargo on the former president's assets totaling 10 million pesos. However, he also decided to lift the travel ban that was imposed on him.
In his 184-page ruling, Ercolini considered the power asymmetry between Fernández and Yáñez to be decisive, highlighting the habitual nature of the episodes of violence. "Several elements have been gathered that account for the habitual and continuous nature that the violence, in various forms, would have acquired, exercised by the accused over the named Yáñez," the judge stated.

According to Ercolini, Fernández's professional and political development contrasted with Yáñez's more reserved profile, which would reflect a relationship of inequality. "This asymmetry would have been present from the beginning of the relationship and was decisive for the configuration of the various verified violences," the magistrate affirmed.
The case analyzed WhatsApp messages between the former couple, as well as images and testimonies provided by Yáñez. The medical situation of the former first lady was also detailed, along with what was described as Fernández's "obsession" with his partner.
